Appeals Division
The Appeals Division is a specialized division within the Office of the Director of Public Prosecutions (ODPP) situated at Level 1, Gunu House. Our core function is to litigate and defend appeal matters before the High Court, Court of Appeal and Supreme Court. We are also entrusted to closely monitor and identify issues arising from Court decisions that need to be appealed. Apart from these, the Appeals Division works closely with all Legal Officers in terms of advising, vetting opinions and preparing documentations for appeal.
The procedural requirements vary for different Courts and are provided for under the Criminal Procedure Act, the Court of Appeal Act and the Supreme Court Act. Perhaps the most crucial factor, after ensuring there are merits of an appeal, is the ‘time factor’. From the appeal period within which appeals must be filed to adhering to timelines directed by Courts, time is of essence in the Appeals Division.
Appeals Team
The Appeals Division is led by our Assistant Director of Public Prosecutions, Ms. Pauline Madanavosa. She was appointed to lead the Appeals Division from when it was first established in 2018. The appeals team members are Principal Legal Officers, Mr Rajneel Kumar and Ms Kimberly Semisi. The appeals team is also assisted by other counsel who conduct appeals at the High Court, Court of Appeal and Supreme Court.
Together, the dynamic group makes up the Appeals Division. The Appeals Division, just like other divisions, also has paralegals who assist where needed.
